1. Introduction
1.1 Welcome to Tammy Tender Touch Rehab (“Facility,” “we,” “us,” or “our”). These Terms and Conditions govern the relationship between Tammy Tender Touch Rehab and each client (“Client,” “you,” or “your”) admitted into our halfway house program. By enrolling or staying in our Facility, you (“Client”) agree to abide by all policies, rules, and requirements set forth herein.
1.2 The purpose of these Terms and Conditions is to ensure a safe, supportive, and structured environment for all residents. They constitute a binding agreement between Tammy Tender Touch Rehab and each Client and outline the rights, responsibilities, and obligations of both parties.
2. Definitions
“Facility”
Tammy Tender Touch Rehab licensed halfway house located at [Facility Address].
“Client”
An individual admitted into Tammy Tender Touch Rehab’s program, who has executed any required intake forms and agreed to these Terms and Conditions.
“Program”
The residential services, counseling, educational sessions, and rules-based structure provided to Clients during their stay.
“Staff”
All employees, contractors, volunteers, and agents of Tammy Tender Touch Rehab involved in the care, supervision, or administration of the Facility or Program.
“Rules”
All house rules, schedules, curfews, prohibited items, and behavioral expectations posted in the Facility or otherwise communicated to Clients.
3. Admission Criteria and Intake
3.1 Eligibility
Clients must:
• Be at least 18 years of age (or have guardian consent if younger, per state regulations).
• Have completed any required detoxification program (if applicable) prior to admission.
• Not pose an imminent danger to themselves or others, including active suicidal ideation without stabilization.
• Provide accurate disclosures regarding substance use history, mental health diagnoses, criminal background, and any other information deemed necessary by Tammy Tender Touch Rehab.
3.2 Application and Documentation
Prior to admission, Clients must submit:
• Intake forms (medical history, emergency contact information, consent for treatment).
• Proof of identity (government-issued photo ID).
• Any required release forms (e.g., for medical records, insurance verification).
We reserve the right to deny admission if documentation is incomplete or information provided is determined to be false or misleading.
3.3 Acceptance of Terms
By signing the Intake Agreement and/or moving into the Facility, the Client acknowledges receipt of and agreement to these Terms and Conditions. Failure to sign or comply with these Terms and Conditions may result in denial of admission or immediate discharge.
4. Program Rules and Client Responsibilities
4.1 General Conduct
Clients must:
• Treat Staff, visitors, and fellow Clients with respect and courtesy at all times.
• Refrain from violence, threats, harassment, or intimidation.
• Comply with schedules for meals, group sessions, chores, curfews, and other Program requirements.
4.2 Substance Use
• Strictly prohibited: possession, use, or distribution of alcohol, illicit drugs, or non‐prescribed controlled substances on Facility premises or during any Facility‐sanctioned activity.
• Prescription medications must be disclosed at intake. All medication must be kept in a locked cabinet or with designated medical personnel; self‐administration of controlled substances without Staff approval is prohibited.
• Random drug and alcohol screenings may be conducted at Staff’s discretion. A positive screen or refusal to submit to a test will be considered a breach of these Terms and Conditions.
4.3 Curfew and Visitation
• Clients must adhere to the posted curfew (typically between 9:00 PM and 6:00 AM, unless otherwise communicated). Late returns will be documented and may result in disciplinary action, up to discharge.
• Visitors are permitted only during approved visiting hours and must register at the front desk. All visitors are subject to search, and prohibited items brought into the Facility will be confiscated.
• Unapproved or unscheduled guests are not allowed on Facility grounds; violation may lead to immediate discharge.
4.4 Housekeeping and Chores
• Clients are responsible for maintaining the cleanliness of their assigned living area.
• Clients will be assigned regular chores (e.g., kitchen duty, laundry rotation, common‐area cleaning) as part of communal responsibility. Failure to complete assigned chores may result in disciplinary measures.
4.5 Property and Prohibited Items
• Clients are responsible for their personal belongings. Tammy Tender Touch Rehab is not liable for lost, stolen, or damaged personal property.
• Prohibited items include weapons, illicit substances, drug paraphernalia, pornographic materials, and any item deemed unsafe by Staff. Discovery of prohibited items may lead to immediate discharge and potential legal referral.
4.6 Behavioral Expectations
• Participation in Group Therapy, Counseling Sessions, and Educational Workshops is mandatory unless excused by Staff for medical or other valid reasons.
• Clients must refrain from any form of bullying, intimidation, or disruptive behavior that undermines the recovery environment.
• Use of profanity, hate speech, or discriminatory remarks based on race, gender, religion, sexual orientation, or any protected class will not be tolerated.
5. Fees, Payments, and Insurance
5.1 Fee Schedule
Clients are responsible for all fees associated with their stay. Fees may include, but are not limited to:
• Program Enrollment Fee (one‐time, upon admission).
• Weekly Residential Fee (covers room, board, basic counseling, and group activities).
• Additional Fees (e.g., specialized counseling, after‐hours clinical services, transportation arrangements).
A detailed fee schedule is provided at intake. Fees are subject to change with 30 days’ written notice.
5.2 Payment Terms
• Clients agree to pay all fees in advance, according to the payment plan agreed upon at intake (e.g., weekly, bi‐weekly, or monthly).
• Late payment (more than 5 calendar days past due) will incur a late fee of $50 per week or result in program suspension until payment is made in full.
• Nonpayment for more than two consecutive billing cycles may result in discharge.
5.3 Insurance and Third‐Party Billing
• Tammy Tender Touch Rehab may accept certain insurance plans (e.g., Medicaid, private insurers) pending verification of coverage for residential or rehabilitation services.
• Clients must provide all necessary insurance information at intake. Any co‐payments, deductibles, or uncovered expenses remain the Client’s responsibility.
• If coverage is denied or rescinded, the Client must assume payment of all outstanding balances immediately.
5.4 Refund Policy
• Unused portions of pre‐paid fees are refundable upon discharge, minus any outstanding balances or fees for services rendered.
• If the Facility terminates the Client for cause (e.g., gross misconduct, repeated policy violations), no refunds will be issued.
6. Confidentiality and Privacy
6.1 Client Records
• All Client records, including intake forms, medical information, counseling notes, and progress reports, are maintained in accordance with applicable state and federal privacy laws (e.g., 42 CFR Part 2, HIPAA).
• Only authorized Staff and clinical personnel have access to protected health information.
6.2 Client Rights
• Clients have the right to review their own records, request corrections to factual inaccuracies, and obtain copies, subject to Facility policies and applicable law.
• Clients’ personal information will not be disclosed without the Client’s written consent, except as required by law (e.g., reporting child abuse, imminent threat of harm to self or others, court order).
6.3 Group Sessions
• Group Therapy and educational sessions are confidential to the extent possible. Clients agree not to share personal information or session content outside of the session.
• Breach of group confidentiality undermines trust and may result in corrective action, including probation or discharge.
7. Health, Safety, and Liability
7.1 Medical Services
• Clients must disclose any known medical or mental health conditions at intake. Failure to do so may result in discharge if it jeopardizes their well‐being or that of others.
• Staff can facilitate medical or psychiatric referrals as needed. Clients are generally responsible for all medical expenses incurred outside the Facility.
7.2 Medication Management
• Clients must submit all medications to the designated medical staff upon admission. Self‐medication of controlled substances without authorization is prohibited.
• Any changes to prescriptions must be reported immediately to medical personnel.
7.3 Safety Protocols
• Fire drills, emergency evacuation procedures, and safety protocols must be followed at all times. Failure to comply may result in disciplinary action.
• Any unsafe conditions (e.g., broken fixtures, electrical hazards, unsanitary conditions) must be reported promptly to Staff.
7.4 Liability Waiver
• Clients recognize that participation in rehabilitation activities carries inherent risks. By signing intake forms, Clients release Tammy Tender Touch Rehab, its Staff, agents, and representatives from liability for any injury, loss, or harm that may occur while on Facility premises or during Facility‐sanctioned activities, except to the extent caused by Facility’s gross negligence or willful misconduct.
8. Disciplinary Action and Termination
8.1 Progressive Discipline
• Minor infractions (e.g., missed chores, curfew violation) may result in verbal warnings, reflective assignments, or temporary loss of privileges (e.g., no communal recreation for 24 hours).
• Repeated or serious violations (e.g., possession of contraband, violence, theft) may lead to immediate suspension or discharge.
8.2 Grounds for Immediate Discharge
• Possessing or distributing alcohol, illicit drugs, or weapons.
• Physical assault, threats, or any form of violence toward Staff or other Clients.
• Sexual harassment, abuse, or exploitation.
• Repeated violation of Program Rules after multiple warnings.
• Violation of confidentiality that places others at risk.
8.3 Voluntary Withdrawal
• Clients may request to leave the Program at any time by submitting a written notice to Admissions or Program Director.
• Clients who voluntarily withdraw are responsible for payment of all fees incurred up to the date of departure. Any refund will be processed per Section 5.4.
8.4 Post‐Discharge Procedures
• Upon discharge (voluntary or involuntary), Clients must return any Facility property (e.g., keys, badges, counseling materials) and settle outstanding balances.
• Clients may request a final summary of treatment or verification of stay; such requests must be made in writing within 30 days of discharge.
9. Privacy Policy and Data Use
9.1 Collection of Personal Data
• Tammy Tender Touch Rehab collects personally identifiable information (PII) and protected health information (PHI) solely for the purpose of providing comprehensive residential treatment and complying with legal requirements.
9.2 Use of Data
• Data is used to:
• Develop individualized treatment plans.
• Coordinate care with medical providers and insurers.
• Comply with mandatory reporting obligations (e.g., court orders, child or elder abuse).
9.3 Data Security
• We employ appropriate administrative, physical, and technical safeguards to protect Client information against unauthorized access, disclosure, alteration, or destruction.
9.4 Third‐Party Disclosure
• We will not sell or rent Client information to third parties.
• Disclosure to third parties occurs only as required by law or with the Client’s written consent (e.g., for academic research, continuity of care).
9.5 Data Retention
• Client records will be retained for a minimum of seven (7) years from the date of discharge, or longer if required by applicable law.
10. Intellectual Property
10.1 Facility Materials
Tammy Tender Touch Rehab owns or licenses all materials used in therapeutic curricula, educational handouts, website content, and promotional literature. Clients may not reproduce, distribute, or modify these materials without express written permission.
10.2 Client‐Generated Content
Any written assignments, artwork, or other creative work produced by Clients during their stay remain the property of the Client unless otherwise agreed upon in writing. By sharing creative work in group settings, Clients grant Tammy Tender Touch Rehab a nonexclusive license to use anonymized excerpts for educational or promotional purposes.
